3. Prices, Taxes, and Promotions
Prices are shown in USD and may change before an order is placed. Applicable taxes and any optional charges are displayed at checkout. Promotions are subject to their stated dates, eligibility, product exclusions, and quantity limits. Unless stated otherwise, promotions cannot be combined, applied retroactively, redeemed for cash, or transferred.
4. Orders and Acceptance
Submitting an order is an offer to purchase. We may accept, decline, limit, or cancel an order for reasons such as unavailable inventory, an undeliverable destination, a payment problem, a suspected fraudulent transaction, a pricing error, or a violation of these Terms. An automated confirmation means the order was received; it does not waive order review. If a canceled order was charged, the appropriate amount will be refunded to the original payment method.

6. Shipping, Cancellation, and Address Changes
Shipping destinations, charges, the 6:00 PM (UTC-5) cutoff, and business-day estimates are stated in the Shipping Policy. Cancellation requests and address changes must be sent within 24 hours after the order is placed, but cannot be guaranteed after fulfillment begins or shipment occurs. Delivery estimates are not guaranteed dates.
7. Returns and Refundsa
Return eligibility, item-condition requirements, non-returnable goods, return shipping responsibility, refund timing, and the no-direct-exchange process are stated in the Return and Refund Policy. That policy forms part of these Terms.
8. Reviews and Other Submitted Content

Do not submit private information, unlawful content, malware, impersonation, paid endorsements that are not disclosed, or material you do not have permission to use. You keep ownership of your content but grant gearysales.com a non-exclusive, worldwide, royalty-free license to host, reproduce, format, and display it for store operation and promotion. We may moderate or remove content that violates these Terms, while respecting applicable law.
9. Acceptable Use
You may not use the site to commit fraud, interfere with security, introduce harmful code, scrape or harvest data without authorization, place orders for unlawful resale or export, infringe another person's rights, misrepresent identity or affiliation, abuse payment disputes, or disrupt other customers' use. Automated access is permitted only when expressly authorized in writing or required by applicable law.
10. Intellectual Property
The site's original text, graphics, arrangement, and branding are owned by or licensed to gearysales.com. The limited permission to browse and shop does not transfer intellectual-property rights. Third-party trademarks remain the property of their owners.
11. Shopify and Third-Party Services
The store is hosted on Shopify. Shopify and connected service providers process information when visitors browse the store, use checkout, or make purchases, as needed to operate the platform, prevent fraud, process transactions, and provide enabled services. Depending on store settings and consent choices, Shopify may also provide services informed by a visitor's interactions with Shopify and other merchants. Third-party services are governed by their own terms and privacy notices. 12. Disclaimers
To the maximum extent permitted by law, the site is provided on an 'as available' basis. We do not exclude warranties, consumer rights, or remedies that cannot legally be excluded.
13. Limitation of Liability
To the maximum extent permitted by law, gearysales.com will not be liable for indirect, incidental, special, punitive, or consequential losses arising from site use or an order, including lost profits or lost data, when such losses were not reasonably foreseeable. For a claim relating to a product or order, total liability will not exceed the amount paid for the affected product or order. These limitations do not apply where prohibited, including liability that cannot legally be limited.

This section does not require you to indemnify a party for its own unlawful conduct.

Before filing a claim, please email support@gearysales.com and allow 30 days for a good-faith effort to resolve the issue. Unless applicable law permits a different venue, legal proceedings may be brought in the state or federal courts located in or serving George County, Mississippi.
17. General Terms
If a provision is held unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign an order or these Terms without consent; we may assign them as part of a lawful reorganization, transfer, or service transition without reducing customer rights. These Terms, together with the policies incorporated above, form the agreement concerning site use and purchases.
